Terms of Service

These Terms of Service ("Terms") govern your use of https://shop.humanhopefoundation.com (the "Site") and any purchase of supporter items from Human Hope Foundation ("we", "us" or "our"). Please read them together with our Privacy Policy and Refund, Return & Shipping Policy, which form part of these Terms.

1. Acceptance of these Terms

By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site or place an order.

3. Eligibility

You must be at least 18 years old and able to enter into a binding contract to place an order. By ordering, you confirm that the information you provide is accurate and complete and that you are authorized to use the payment method.

4. Supporter items and mission support

The Site sells physical merchandise that we call "supporter items" (jewelry, apparel, gift sets, bags, home items and the complete supporter kit), priced in US dollars from $25 to $200. Each listed price is a single purchase price for the item that includes support for the foundation's programs; it is not split into a product price and a separate donation.

6. Product listings and images

Product images are renderings rather than photographs of the exact unit you will receive, and minor variations in color, finish or materials may occur. If a listing contains an error in its description, image or price, we may correct it and, where the error affects an order already placed, cancel and fully refund that order.

7. Pricing and currency

All prices are shown and charged in US dollars (USD) and include shipping within the United States. We may change prices at any time, but changes do not affect orders we have already accepted. Any applicable sales tax is shown before you confirm payment.

8. Orders, acceptance and cancellation

Your order is an offer to purchase, which we accept when we send an order confirmation email. We may refuse or cancel an order if an item is unavailable, a listing or price is wrong, we cannot verify your payment or shipping details, or we suspect fraud; if the order has already been paid, we refund the full amount to the original payment method. You may cancel an order before dispatch by emailing us with your order number.

9. Payment

Payments are processed by Stripe, Inc. ("Stripe"). By submitting your payment details on Stripe's secure checkout, you authorize the full order amount to be charged to your card. We do not receive or store full card numbers, and Stripe's own terms and privacy policy apply to the processing of your payment.

10. Shipping, returns and refunds

Shipping times, the 30-day return window, refund timing and our process for damaged, defective or wrong items are set out in the Refund, Return & Shipping Policy, which is incorporated into these Terms.

11. Intellectual property

The Human Hope Foundation name and logo and all content on the Site belong to Human Hope Foundation and are protected by copyright, trademark and other laws. You may view and print pages for personal, non-commercial use, but you may not copy, modify, distribute or otherwise use our name, logo or content, or suggest any affiliation with us, without our prior written permission.

12. Acceptable use

You agree not to use the Site unlawfully or fraudulently; to provide false identity, address or payment information; to interfere with its operation or security; to use bots, scrapers or other automated tools; or to attempt unauthorized access to any system or data. We may suspend access and cancel orders that violate these rules.

13. Disclaimer of warranties

The Site is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties about the Site and its content, including that it will be uninterrupted or error-free. Supporter items remain covered by our Refund, Return & Shipping Policy and by consumer protections that cannot be excluded by law.

14. Limitation of liability

To the fullest extent permitted by law, Human Hope Foundation and its directors, officers, employees, volunteers and agents are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from the Site or any order, and our total liability for any claim related to an order will not exceed the amount you paid for that order.

15. Indemnity

You agree to indemnify and hold harmless Human Hope Foundation and the persons listed above from any claims, losses and expenses, including reasonable attorneys' fees, arising from your breach of these Terms, your misuse of the Site, or your violation of any law or third-party rights.

16. Disputes and chargebacks

If you have a problem with an order, please contact us first at support@humanhopefoundation.com. We acknowledge every message within two business days and usually resolve it, by replacement or refund, within five. If you dispute a charge with your card issuer, we respond with our order, shipping and correspondence records, and we may decline future orders from customers who file chargebacks on orders that were delivered as described.

17. Changes to these Terms

We may revise these Terms by posting the updated version here with a new "Last updated" date. The version in effect when you place an order applies to that order.

18. Governing law and venue

These Terms and any dispute arising from them or from the Site are governed by the laws of the State of New Mexico, without regard to its conflict-of-laws rules. The state and federal courts located in Bernalillo County, New Mexico, have exclusive jurisdiction, except where mandatory consumer protection law provides otherwise.
